How Can I Avoid Being Charged With a Mississippi DUI During the Holiday Season?

Posted on : November 16, 2020, By:  J Brian Kelley

Seasonal festivities are just around the corner, and it’s common to find alcoholic drinks at holiday parties at both work and home. However, Mississippi sees a rise in DUI stops around the holidays, making travelers nervous.

Whether you’re driving on a major highway or back roads, here are ways you can reduce the chances of being stopped and charged with a DUI during the holiday season.

Don’t Consume Enough Alcohol to Put Your BAC Over 0.08%

How much alcohol is required to elevate a person’s BAC (Blood Alcohol Content) level to 0.08% or above varies substantially depending on a number of different factors. For example, how much you weigh, how old you are, whether you’re male or female, what type of drink you consumed, and whether you ate or not can all impact how quickly your BAC rises.

Even the same drink consumed by the same person can cause different BACs on separate occasions. Use a cheap breathalyzer or BAC calculator on your phone to make sure you’re safe to drive.

Call an Uber

It’s difficult to know when you’ve reached your alcohol threshold, and you may pass it before you realize. If this happens, contact a friend to drive you home or call an Uber. Never get behind the wheel of your car if you cannot be sure your BAC level is under the legal limit of 0.08%.

Never Submit to Field Sobriety Testing

You have the legal right to say no to a field sobriety test if a police officer pulls you over and requests one. You cannot decline a breathalyzer without losing your Mississippi driver’s license for a period of time, but you can — and should — decline field sobriety tests to keep from giving the police even more evidence to use against you.
