How Accurate Are Field Sobriety Tests?

If you are stopped by the police in Mississippi for the suspicion of driving under the influence, you may be subjected to a field sobriety test, very often that test is a breathalyzer test. With up to 20% margin of error, the breathalyzer test may not be as accurate as you believe.  While the latter remains a popular sobriety test that is commonly used in the field by law enforcement, it may not be the best test to utilize when measuring the level of intoxication. The breathalyzer test is convenient for law enforcement to use out on the road and is fairly simple to use, however, to accurately measure your alcohol content, having a blood test administered would provide more accuracy. Due to the nature of field sobriety tests, blood testing is not possible or convenient. This may be to your benefit during your defense.

Equipment Upkeep and Maintenance

Like any piece of equipment, a Breathalyzer is subject to maintenance. The breathalyzer must be regularly checked to ensure proper calibration and accuracy. It is a requirement that police officers keep this equipment functioning optimally at all times. When this equipment is not maintained according to policy, the accuracy of the Breathalyzer readings may be called into question. It is possible for it to register higher or lower than the legal limit and in the case of an inaccurately high reading, it is possible for an individual to be arrested as a result.
